The Bangsamoro Basic Law (BBL) will not going to establish just only by legislation of Congress. This is assured by Sen. Miriam Defensor Santiago on Monday right after the hearing related to BBL.
For Madam Senator, in order to carry out the BBL to its fulfillment, it should be undergo to more complex processes such as amending the Constitution. But she said, this position paper resource from different persons is still under her study for submission and will wait for the inputs of here fellow senators before issuing the committee report.
The Bangsamoro Transition Commission Chairman Mohagher Iqbal defended the bill which for him is subjected to the provisions of the constitution. Iqbal insisted that the Bangsamoro police will remain part and under the leadership of the PNP.
But former deputy House Speaker Pablo Garcia replied, BBL is unsuitable with the constitution and that would only allow the creation of the Bangsamoro political entity. Garcia criticized lawmakers who promoting BBL saying that filing of this bill in Congress is a needless and an exercise in futulity.
Passing the BBL, they will face more prevalent legal obstacle.
It mentioned that in accordance with the Constitution, Congress has no power to establish new territorial and political subdivisions or entity other than those authorized and mentioned in article 10 of the Local Government of the Constitution.
He said that under the 1987 Constitution, there are only five cited teritorial and political subdivision.
Including barangays, municipalities, cities, provinces, autonomous regions such as ARMM and Cordillera Autonomous Region (CAR).
